ARCANE INKWORKS GENERAL TERMS & CONDITIONS


1. DEFINITIONS

The following terms are used in these General Terms and Conditions:

  • 1.1 Arcane Inkworks located at Ridderstraat 4 in Breda, a sole proprietorship run by Laura Rijnen, hereinafter referred to as Arcane Inkworks.

  • 1.2 Client: the natural person who gives an order to Arcane Inkworks to have a tattoo applied that is treated by Arcane Inkworks or to whom Arcane Inkworks supplies products or services.

  • 1.3 Agreement: any agreement between Arcane Inkworks and the Client for the delivery of products or services, including the application of a tattoo and/or piercing.


2. APPLICABILITY

  • 2.1 These General Terms and Conditions apply to all agreements between Arcane Inkworks and the Client, whereby Arcane Inkworks acts as a (potential) seller and/or supplier of products and/or services. These General Terms and Conditions can only be deviated from in writing and with the express consent of Arcane Inkworks.

  • 2.2 The Client who enters into an Agreement with Arcane Inkworks expressly agrees to these General Terms and Conditions applied by Arcane Inkworks


3. YOUR OWN RESPONSIBILITY AND RISK

  • 3.1 All assignments from the Client to Arcane Inkworks are provided under the Client's own responsibility and risk.

  • 3.2 By instructing Arcane Inkworks to apply a tattoo/piercing, the Client declares that he/she is aware of all possible consequences of the treatment, including medical, psychological and social consequences.

The Client is aware that body decorations applied by or on behalf of Arcane Inkworks can never be removed completely or in a cosmetically attractive manner.

  • 3.3 By instructing Arcane Inkworks to apply a tattoo/piercing, the Client also declares that he/she is in good health, does not suffer from any form of allergy, hemophilia, diabetes, immune disorder, skin condition or otherwise and is not infected with blood-borne diseases (such as HIV, hepatitis A, B or C or the like) and that his/her treatment cannot in any way endanger the health of the Arcane Inkworks employee or third parties to take.

  • 3.4 The Client guarantees that he/she is 16 years or older and has made a well-considered decision to have a tattoo applied by Arcane Inkworks. In the event that the person who wishes to be treated by Arcane Inkworks is between the ages of 16 and 18, the treatment/delivery by Arcane Inkworks will only take place with written permission and in the presence of his/her parent or guardian. In that case, the parent/guardian is considered the Client.

  • 3.6 Arcane Inkworks does not treat persons under the age of 16.

  • 3.7 Arcane Inkworks always has the right to ask the Client to show valid proof of identity, to make and keep copies thereof. If the Client does not show a valid ID, Arcane Inkworks has the right to refuse the assignment.

  • 3.8. The Client gives permission, provided that the identity remains hidden, to have photo and video images made by Arcane Inkworks used as promotional material on social media and advertising of Arcane Inkworks and their portfolios.


4. LIABILITY

  • 4.1 By instructing Arcane Inkworks, the Client acknowledges that Arcane Inkworks has a best efforts obligation. Arcane Inkworks will make every effort to achieve the intended result. Arcane Inkworks can never guarantee that the intended result will actually be achieved. Arcane Inkworks is not liable for failure to achieve the intended result or not to fully achieve it, nor for damage that could arise as a result of a treatment, unless it is established that the damage is due to intent or gross negligence.

  • 4.2 In the event that Arcane Inkworks is found liable for any damage suffered by the Client, compensation will be limited to the amount that Arcane Inkworks has charged the Client for the relevant delivery of products or services.

  • 4.3 Any right to compensation will in any case lapse insofar as the Client has not taken measures immediately after the damage occurred to limit the damage or to prevent further or other damage, and has not informed Arcane Inkworks of this as soon as reasonably possible. of all relevant information.

  • 4.4 Arcane Inkworks stipulates all legal and contractual defenses that it can invoke to ward off its own liability towards the Client.

  • 4.5. In the event that an appointment made by the Client for treatment at Arcane Inkworks is canceled after the creation process and delivery of the design, a fee will still be paid for the service of creating the delivered design. This amount is 10% of the total price of the tattoo design, or a previously agreed upon amount of money.


5. WARRANTY

  • 5.1 Arcane Inkworks uses body-safe materials for piercing, and for tattooing only uses tattoo inks that have been checked and are under the control of the Dutch Ministry of Health, as determined in the Commodities Act Decree on Tattoo Dyes.


6. APPLICABLE LAW/COMPETENT COURT

  • 6.1 Dutch law applies to these General Terms and Conditions, as well as to all agreements to which the general terms and conditions apply or are also applicable.

  • 6.2 Disputes between Arcane Inkworks and the Client, arising from the agreements to which the general terms and conditions apply or are also applicable, will be adjudicated exclusively by a competent judge of the District Court, unless Arcane Inkworks, as claimant or requesting party, expressly opts for the competent court of the Client's place of residence or business.


7. CONVERSION

  • If and insofar as any provision in these general terms and conditions cannot be relied upon on the grounds of reasonableness and fairness or its unreasonably onerous nature, that provision will have a meaning that is as similar as possible in terms of content and scope, so that it can be invoked.


8. FINAL PROVISION

  • Getting a tattoo by Arcane Inkworks is always at your own risk, both by oral and written agreement.




  • You agree to pay the full amount for our services the day of the service.

RISK DISCLAIMER

Do not get a tattoo:


  • in places where you have undergone plastic surgery or radiation in the past year;

  • on a scar that is less than a year old;

  • on a spot tattooed less than six weeks ago;

  • in a place where a tattoo was lasered away less than three months ago;

  • on irritated skin such as bumps, dark moles or swellings;

  • if you are under the influence of alcohol or drugs;

  • if you are allergic to tattoo materials or ink.

  • if in doubt, consult an Arcane Inkworks representative.


In addition, it is not recommended to get a tattoo if one of the following situations applies to you:

  • diabetes

  • problems with blood clotting

  • chronic skin disease

  • a reduced immune system

  • cardiovascular abnormalities

  • pregnancy or breastfeeding

  • Does one of these situations apply to you, but do you still want to get a tattoo? Then we strongly recommend that you first discuss your plans for a tattoo with your treating doctor. Your doctor has the best insight into the stability of your physical condition (with or without the use of medication). This allows him or her to best assess the risks when you get a tattoo. In addition, read the advice below, which provides some additional explanation about the risks of a tattoo in your situation.


ADVICE FOR PEOPLE WITH DIABETES

Make sure your hemoglobin A1c level and overall blood glucose levels are under control before getting tattooed. This reduces the chance of contracting a wound infection or inflammation during and after tattooing. To ensure the correct level, it is best to prick yourself just before tattooing.

In general, discuss your plans for getting a tattoo with your doctor first.



ADVICE FOR PEOPLE WITH A BLOOD CLOTTING DISORDERS AND PEOPLE USING ANTICOAGULANTS

If you have a blood clotting disorder or are taking anticoagulants, your skin may bleed more quickly and bleed for longer during tattooing than other people. To minimize the risk of serious bleeding, large tattoos are not recommended. If you want a large tattoo, preferably have it done during multiple, shorter sessions.

In general, discuss your plans for getting a tattoo with your doctor first. Your doctor is the best judge of the status of your blood values. 


ADVICE FOR PEOPLE WITH A CHRONIC SKIN DISEASE

In the case of a chronic skin disease (such as psoriasis or sarcoidosis in the skin), there is a chance that you will also develop your skin complaints in the place that you have had a tattoo. This is called the Koebner phenomenon. To reduce the risk of this, it is not recommended to get a tattoo at times when your skin disease is very active. And preferably do not get a tattoo in places where your skin disease often occurs.

If you have ever had melanoma (skin cancer), or if this runs in your family, it is not recommended to get a tattoo. New melanomas are more difficult to detect at an early stage on tattooed skin.

In general, discuss your plans for getting a tattoo with your doctor first.


ADVICE FOR PEOPLE WITH AN IMMUNE DISORDER OR MEDICATIONS THAT CAN WEAKEN THE IMMUNE SYSTEM

Even if the procedure is done safely and hygienically, you run the risk of infections when getting a tattoo. If you have an immune disorder (this also includes leukemia) or are taking medications that can weaken the immune system, this risk is increased. Therefore, always discuss your plans for getting a tattoo with your treating doctor first.


ADVICE FOR PEOPLE WITH HEART OR VESSEL DISEASE

If you have cardiovascular disease, there is a risk that you may contract endocarditis (an infection of the inner lining of the heart) from tattooing. Because of this risk, it is not recommended to get a tattoo if you do not have optimal control of your heart condition.

In general, always discuss your plans for getting a tattoo with your treating doctor first.


ADVICE FOR PREGNANT AND BREASTFEEDING WOMEN

Do not get a tattoo or piercing if you are pregnant or breastfeeding. Not all risks associated with tattooing for pregnant women are known. Furthermore, if you contract an infection as a result of the tattoo/piercing, you may not be able to use certain medications to combat the infection, due to the risk to your (unborn) child.
